Regulations

Terms and Conditions of Sale of Antykwariat Polski

These Terms and Conditions set out the rules for the sale of goods through the website https://antykwariat-polski.pl (the “Website”). By placing an order, the Customer accepts these Terms and Conditions.

1. Definitions

1.1. “Antykwariat” – ANTYKWARIAT POLSKI SP. Z O.O., registered office in Warsaw, ul. Piękna 11b/1, 00-549 Warszawa, Poland, NIP (tax ID): 7011068927, KRS: 0000945046, REGON: 521014579, e-mail: info@antykwariatpolski.pl, tel. +48 608 331 500.

1.2. “Customer” – a natural person, legal person or organisational unit placing an order.

1.3. “Consumer” – a Customer who is a natural person making a purchase not directly related to their business or professional activity. The provisions concerning Consumers also apply to a natural person running a business where the contract is not of a professional nature for that person (Article 38a of the Polish Consumer Rights Act).

1.4. “Order” – a declaration made by the Customer on the Website with a view to concluding a sales contract.

2. Orders

2.1. Orders can be placed on the Website 7 days a week, 24 hours a day.

2.2. The sales contract is concluded when Antykwariat confirms acceptance of the Order by e-mail sent to the Customer. In the case referred to in the second sentence of section 4.2, the contract is concluded when the Customer accepts the delivery cost.

2.3. The Customer provides true details: first and last name, e-mail address, telephone number and delivery address.

2.4. Antykwariat may refuse to accept an Order, in particular where the details provided are incorrect or the item is unavailable (most items are single copies). Antykwariat informs the Customer of a refusal or delay by e-mail within 7 days of the Order being placed and refunds any payments without delay.

2.5. Information about goods on the Website constitutes an invitation to conclude a contract (Article 71 of the Polish Civil Code). Prices are given in Polish złoty and include VAT.

2a. Electronic services

2a.1. Antykwariat provides the following electronic services on the Website free of charge: the Order form, the Customer account, the newsletter and the enquiry form.

2a.2. To use the Website you need: a device with internet access, an up-to-date web browser with cookies and JavaScript enabled, and an active e-mail address.

2a.3. The contract for an account is concluded upon registration, and the newsletter contract upon confirmation of subscription. These contracts are concluded for an indefinite period. The Customer may terminate them at any time without giving reasons: by deleting the account, by sending an e-mail to info@antykwariatpolski.pl or, for the newsletter, by clicking the unsubscribe link in a message. Use of the Order form and the enquiry form ends when the form is sent or left.

2a.4. The Customer may not provide unlawful content.

2a.5. Complaints concerning electronic services may be submitted by e-mail to info@antykwariatpolski.pl. Antykwariat responds within 14 days of receiving the complaint.

2a.6. These Terms and Conditions are available free of charge on the Website in a form that allows them to be downloaded, stored and printed.

3. Payments

3.1. Available payment methods: bank transfer, fast online transfer via the Przelewy24 system, and cash on personal collection.

3.2. The Customer pays within 7 days of confirmation of the Order. If payment is not received within that time, Antykwariat may withdraw from the contract after first calling on the Customer by e-mail to pay within an additional period of 3 days. The Order is processed upon receipt of full payment.

4. Delivery and personal collection

4.1. Antykwariat ships goods worldwide via the courier company DPD.

4.2. The delivery cost depends on the chosen method and country and is shown before the Order is placed. For countries outside Europe the delivery cost cannot be calculated in advance: in the basket it is marked as “Shipping quote by e-mail”. In that case Antykwariat informs the Customer of the delivery cost by e-mail, and the sales contract is concluded only once the Customer accepts that cost. If the Customer does not accept it, the Order is cancelled and any payments are refunded without delay, and in any event within 14 days.

4.3. Paid Orders are dispatched on the following weekend (Saturday or Sunday). Delivery after dispatch usually takes 1 to 7 working days, depending on the destination country. If the DPD Next Day service is chosen, the parcel is delivered on the next working day after dispatch. Goods are delivered no later than 30 days after conclusion of the contract, unless another date has been agreed with the Customer, in particular in the case referred to in section 4.6.

4.4. Goods are carefully packed to protect the binding and the book block.

4.5. The Customer may collect the Order in person at Antykwariat, ul. Piękna 11b/1, Warsaw, by prior appointment.

4.6. Export of certain historic books, manuscripts and maps from Poland requires a permit under the Polish Act on the Protection and Care of Monuments. In such a case Antykwariat informs the Customer by e-mail, and the Customer may cancel the Order with a full refund.

4.7. For shipments outside the European Union, customs duties, import taxes and customs fees in the destination country are borne by the Customer.

5. Withdrawal from the contract (returns)

5.1. A Consumer who has concluded a distance contract (an order via the Website) may withdraw from it without giving any reason within 14 days of receiving the goods. This also applies to Orders placed on the Website with personal collection.

5.2. To withdraw from the contract, it is sufficient to send a clear statement before the deadline, e.g. by e-mail to info@antykwariatpolski.pl or by letter to the address of Antykwariat. The model withdrawal form at the end of these Terms and Conditions may be used, but this is not obligatory.

5.3. The Consumer returns the goods to the address of Antykwariat without delay and no later than 14 days from the date of withdrawal. The direct cost of returning the goods is borne by the Consumer. Please pack the book carefully.

5.4. Antykwariat refunds all payments, including the cost of the original delivery (up to the cost of the cheapest delivery method offered), without delay and no later than 14 days after receiving the withdrawal statement, using the same payment method unless the Consumer agrees to another. Antykwariat may withhold the refund until it has received the goods or proof that they have been sent back.

5.5. The Consumer is liable for any diminished value of the goods resulting from handling beyond what is necessary to establish their nature, characteristics and functioning.

5.6. The right of withdrawal does not apply to contracts for goods that are not prefabricated, are made to the Customer’s specifications or are clearly personalised, in particular bindings or notebooks made to individual order (Article 38 of the Polish Consumer Rights Act of 30 May 2014).

5.7. The right of withdrawal applies only to distance contracts. Goods purchased in the Antykwariat shop in Warsaw cannot be returned. This does not limit the Customer’s rights described in section 6.

6. Complaints (lack of conformity with the contract)

6.1. Antykwariat is liable to the Consumer for any lack of conformity of the goods with the contract under the Polish Consumer Rights Act, for 2 years from delivery of the goods.

6.2. Most of the books offered are antiquarian copies, i.e. used and often old. For each item we provide a description of the condition of the copy, including visible signs of age and use, losses, discolouration, provenance marks (stamps, bookplates, inscriptions) and the scope of conservation work. The condition description forms part of the contract. Antykwariat is liable for the conformity of the goods with the contract, including with the description.

6.3. Complaints may be submitted by e-mail to info@antykwariatpolski.pl or by letter to the address of Antykwariat. Please include a description of the problem, photographs and the order number.

6.4. In the event of a lack of conformity with the contract, the Consumer may request repair or replacement of the goods. Because most books are single copies, replacement is usually not possible. If repair or replacement is impossible or has not been carried out, the Consumer may declare a price reduction or withdrawal from the contract, in accordance with Article 43e of the Polish Consumer Rights Act. Withdrawal is not possible if the lack of conformity is minor.

6.5. Antykwariat responds to a complaint within 14 days of receiving it.

6.6. Please report any damage caused in transit as soon as possible after receiving the parcel, preferably with photographs of the packaging. This makes it easier to claim against the carrier. Failure to report does not deprive the Consumer of their rights.

7. 100-year guarantee

7.1. The guarantor is ANTYKWARIAT POLSKI SP. Z O.O., ul. Piękna 11b/1, 00-549 Warszawa, Poland. Books in bindings made in the Antykwariat bindery are covered by a guarantee for 100 years from the date the book is delivered to the Customer. The guarantee covers the book block (sewing, gluing and the attachment of the block to the binding) and the binding. The guarantee is valid worldwide and passes to subsequent owners of the book.

7.2. The guarantee does not cover: natural ageing of paper and leather, normal wear and tear, mechanical damage, water damage, fire or high humidity, fading from sunlight, or repairs carried out by third parties.

7.3. Under the guarantee, Antykwariat will, at its own cost and in its own bindery, repair the block or binding or rebind the book within 60 days of receiving the book. The cost of sending the book to Antykwariat and back is borne by Antykwariat.

7.4. Claims should be sent to info@antykwariatpolski.pl together with a description, photographs and proof of purchase. Antykwariat responds within 14 days and indicates how to deliver the book.

7.5. At the Customer’s request, Antykwariat issues the guarantee statement on paper or another durable medium.

7.6. The guarantee does not exclude, limit or suspend the Consumer’s rights under the provisions on the seller’s liability for lack of conformity of goods with the contract.

8. Personal data

8.1. The controller of Customers’ personal data is Antykwariat.

8.2. Data are processed in order to fulfil Orders and, for marketing purposes, only with the Customer’s consent.

8.3. The Customer has the right to access, rectify and erase their data. Details are set out in the Privacy Policy available on the Website.

9. Final provisions

9.1. Antykwariat may amend these Terms and Conditions for important reasons: changes in the law, changes in the scope or manner of providing services, changes in payment or delivery methods, or the need to ensure the security of the Website. Amendments do not apply to Orders placed before they take effect. Customers with an account or a newsletter subscription are informed of an amendment by e-mail at least 14 days before it takes effect and may terminate the contract with immediate effect during that period.

9.2. Matters not regulated herein are governed by Polish law, in particular the Civil Code and the Consumer Rights Act.

9.3. Disputes with Customers who are not Consumers are settled by the court having jurisdiction over the registered office of Antykwariat. Disputes with Consumers are settled by the court having jurisdiction under the general rules. Consumers may also use out-of-court dispute resolution, e.g. the assistance of a municipal or district consumer ombudsman (rzecznik konsumentów).

9.4. These Terms and Conditions apply from 22 October 2026.

9.5. These Terms and Conditions are available in Polish and English. Both versions have the same content.
